Can I appeal a valuation?
Information on how to appeal a valuation of a Tuberculosis (TB) reactor animal.
If you or Department of Agriculture and Rural Development (DARD) are dissatisfied with the determination of the market value of any animal you or DARD may submit an appeal to the Tuberculosis/Brucellosis (TB/BR) Valuation Appeals Panel, appointed by DARD for the purpose. Any appeal must be submitted in writing within 30 working days of the determination of market value to which it relates and must be accompanied by a fee of £100, full details of the grounds upon which the appeal is sought including documentary or other evidence, and the change sought to the valuation. Under the Diseases of Animals (Valuation) (Fees) Order (Northern Ireland) 2004 the £100 fee is only applicable to an appeal being brought forward by the owner” of the animal and not in the case of an appeal being brought forward by the Department. Appeals received after 30 working days will not be accepted. The fee will be refunded if your appeal is successful. Further details on the appeals process are available in form VA2 which will be provided to all herdkeepers who do not accept a DARD valuation.
Following consideration of an appeal submitted by you or DARD, the TB/BR Valuation Appeals Panel shall determine the market value of the animal and such determination shall be final and binding on both you and DARD.
